CONCERNING
DETERMINATION OF EXPORT QUOTAS DISTRIBUTION OF IRIAN FRESHWATER CROCODILE (Crocodylus novaeguineae) LEATHER FROM NATURE OF THE SECOND PHASE (JULY-DECEMBER PERIOD) OF 2008

Attachment

Considering:

a. that based on the Decree of the Director General of Forest Protection and Nature Conservation Number SK.06/IV-KKH/2008 concerning Quota of Taking Natural Plants and Catching Wildlife Animal for 2008 Period, the kind of Irian Freshwater Crocodile (Crocodylus novaeguineae) that may be caught from the natural habitat in 2008 is about 15,000 pieces and 13,500 pieces of them can be exported in the form of leather;

b. that based on the Decree of the Director General of Forest Protection and Nature Conservation Number SK.37/IV-KKH/2008 already determined Distribution of Irian Freshwater Crocodile (Crocodylus novaeguineae) Leather From Nature of the first Phase (March to June Period) of 2008 which ended on June 30, 2008;

c. that based on the considerations as intended in paragraphs a, b and c above, it is necessary to stipulate Decree of the Director General of Forest Protection and Nature Conservation concerning Determination of Export Quotas Distribution of Irian Freshwater Crocodile (Crocodylus novaeguineae) Lather from Nature of the Second Phase (July - December Period) of 2008.

In view of:

1. Law Number 5 of 1990 concerning Conservation of Bio Natural Resources and Their Ecosystems;

2. Law Number 41 of 1999 concerning Forestry as amended by Law Number 19 of 2004 concerning Stipulation of Government Regulation in Lieu of Law Number 1 of 2004 concerning Amendment to Law Number 41 of 1999 concerning Forestry;

3. Government Regulation Number 13 of 1994 concerning Catching Hunting Animals;

4. Government Regulation Number 7 of 1999 concerning the Preservation Kinds of Flora and Fauna;

5. Government Regulation Number 8 of 1999 concerning Utilization Kinds of Flora and Wildlife Fauna;

6. Government Regulation Number 45 of 2004 concerning the Protection of Forests;

7. Government Regulation Number 38 of 2008 concerning Division of Affairs between the Government, Provincial Government and District/City Government;

8. Decree of the President of the Republic of Indonesia Number 43 of 1978 concerning Ratification of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES);

9. Decree of the Minister of Forestry Number 2827/Kpts-II/2002 concerning the Determination Freshwater Crocodile (Crocodylus novaeguineae) and Muara Crocodile (Crocodylus porosus) as Hunting Fauna in Papua;

10. Decree of the Minister of Forestry Number 104/Kpts-II/2003 concerning the Appointment of the Director General of Forest Protection and Nature Conservation as Management Authority of CITES in Indonesia;

11. Decree of the Minister of Forestry Number 355/Kpts-II/2003 concerning Marking of Flora and Wildlife Fauna Specimens;

12. Decree of the Minister of Forestry Number 447/Kpts-II/2003 concerning Administration of Taking or Catching and Distribution of Flora and Wildlife Fauna;

13. Regulation of the Minister of Forestry Number P.13/Menhut-II/2005 as amended several times and the latest by Regulation of the Minister of Forestry Number P.15/Menhut-II/2008 concerning the Organization and Work Flow of the Ministry of Forestry;

14. Regulation of the Minister of Forestry Number P.19/Menhut-II/2005 concerning Breeding Plants and Wildlife Fauna;

15. Regulation of the Minister of Forestry Number P.02/Menhut-II/2007 concerning Organization and Work Flow of Technical Implementation Unit of the Natural Resources Conservation;

16. Decree of the Director General of Forest Protection and Nature Conservation Number SK.06/IV-KKH/2008 concerning of Quota to Taking Natural Plants and Wildlife Fauna for 2008 Period.

DECIDES:

To stipulate:

DECREE OF THE DIRECTOR GENERAL OF FOREST PROTECTION AND NATUR CONSERVATION CONCERNING DETERMINATION OF EXPORT QUOTAS DISTRIBUTION OF IRIAN FRESHWATER CROCODILE (Crocodylus novaeguineae) LEATHER FROM NATURE OF THE SECOND PHASE (JULY-DECEMBER PERIOD) OF 2008.

FIRST:

To determine Export Quotas Distribution of Irian Freshwater Crocodile (Crocodylus novaeguineae) Leather from nature of the second Phase (July- December Period) of 2008 to the Irian Freshwater Crocodile (Crocodylus novaeguineae) Business Permits as contained in the attachment of this Decree.

SECOND:

Export Quotas Distribution of Irian Freshwater Crocodile (Crocodylus novaeguineae) Leather as intended in FIRST Dictum is maximum limit on the type and quantity of Crocodile Leather speciments are from catching quota that can be used for the purpose of distribution abroad (exports).

THIRD:

Distribution abroad as intended in SECOND Dictum, carried out in accordance with the regulation.

FOURTH:

Export Quotas Distribution of Irian Freshwater Crocodile (Crocodylus novaeguineae) Leather from nature of as intended in SECOND Dictum only valid for the period from July 1, 2008 until December 31, 2008.

FIFTH:

This Decree is effective from the date of stipulation, and applies retroactively from the July 1, 2008.
